Legal Question in Landlord & Tenant Law in Virginia

An unlawful detainer was granted and an eviction took place in late July. On August 1, 2009 the property owner, who was given the unlawful detainer, gave permission to the 'tenant' to continue living on the same property. The property owner has been threatening to have the 'tenant' arrested for trespassing. Does the unlawful detainer or the permission that was given to continue living on the property carry more weight if there is an atempt to have an arrest made or the 'tenant' thrown out?

The permission, if the "tenant" can prove that it was ever actually given by the owner subsequent to the unlawful detainer order (which may not be possible).
