Legal Question in Legal Malpractice in Virginia

Real Estate Dispute

My former attorney who I fired in December 2007, misadvised us on our real estate law suit against the sellers who are trying to defraud us. Due to this grave error it costs us not only substantial legal costs but also lost claim on the property. The judge in a hearing with the new lawyer did not stop short of blaming my former lawyer of mishandling my case. What is the statue of limitation for suing my former lawyer with legal malpractice?

Re: Real Estate Dispute

It is often 1 year. Why did you wait? There may be a small chance still...when did you discover that he committed malpractice?

Re: Real Estate Dispute

If the case is in VA as you indicated, you'll have to ask a VA attorney. If in CA, then the statute is two years. You'll have to prove there was substantial negligence, and that it caused you provable damage that you couldn't mitigate or prevent through new counsel. If that is the case, feel free to contact me if serious about pursuing your claim.
