Legal Question in Real Estate Law in Virginia

My ex-husband passed away recently! We had a home loan together. My name is still on the loan! He lived in the house and his parents payed the payment for him. We have a seven year old daughter together. I paid the loan payment for eight years before our divorce. Do I have the legal right to assume the mortgage loan and move my daughter and I back into the house?

It depends if you are still on the title (deed) to the property. If not, no.
