Legal Question in Real Estate Law in Virginia

A house in our homeowners association was recently sold. The seller owed $400 to our HOA but the settlement company did not check with us for an outstanding amount and did not collect the $400. Now we can't located the seller. Did the settlement company have a legal duty to research, collect, and disburse this money and would they currently have any liability? If it's relevant, we did not have a judgment recorded against the seller, but public records show that the property belongs to a homeowners association.

No, probably not (legal duty regardng this settlement company) but without reviewing the terms of the

contract governing this company in regard to the settlement,, I couldn't say for sure. (This is merely my opinion.)
