Legal Question in Real Estate Law in Virginia

joint ownership/split up

My ex-fiance and I purchased a home together - we have since broken up and I have moved out. He is still living in the house. Both of our names are on the mortgage and the deed stiil. I want him to either buy me out or I want us to sell the house. He refuses to do either and is just sitting on it. Where do I go from here? I understand that due to joint ownership, he has the right to do what he is doing, but what are my legal rights and how do I do something other than just sign the house over with him doing this?

Re: joint ownership/split up

You have a right to sue for a sale in lieu of partition. The house has to be either sold or refinanced to get you off the mortgage.
