Legal Question in Real Estate Law in Virginia

the owner or company working for them of a lot next to ours (property stakes and flags have been out for at least a year and very visible) came on our property without authority, cut down trees, trimmed trees, destroyed trees, ruined our kids tree fort completely, dug in the ground, actually looks like they were digging in our drainfieled and they said so it will grow back. I'm devestated that the property owners did not even contact us let alone the contractor even moved forward. (they are trying to build a house). We have lost privacy, which took over 8 years to grow, kids lost tree forts (huge) dug up our yard in spots. and our drainfield may have been comprimised.

what can we do now.. (btw - these trees were planted 9 years ago in celebration of our youngest sons' birth - who is a special needs kid and can't understand why his fort is destroyed.)

Well, how do these various trees and tree forts and other appurtenances that have now disappeared from the property due to the uninvited efforts of these neighbor's contractors translate into your monetary damages?

Once you have determined these damages (backed by reasonable estimates),

you can then send a written demand letter to your neighbor for

compensation. And, if the neighbor refuses to accept responsibiliy, then

you should arrange for a consultation with an attorney regarding suing this neighbor in the appropriate court.
