Legal Question in Wills and Trusts in Virginia

Adoption

Does a wife have to officially adopt the child of the husband (birth mother deceased)?

My brother passed away (62 yrs old) and we don't know the order of precedence (step mom or siblings). Step mom did not adopt him.

Thanks.

Re: Adoption

For those who die without a will in the Commonwealth, the order of beneficiary inheritance is set out in Va. Code Sec. 64-1.1. (Stepchildren

are not normally considered in these lines of inheritance unless offically adopted by the deceased.)
