Legal Question in Wills and Trusts in Virginia

Who's entitled to what?

Great-granddaddy gives as a gift to granddaddy some land for his natural life and then to go to his children. Granddaddy has 4 children and all marry and have children of there own, but child

#3 dies before granddaddy does. So when granddaddy dies intestate, child #3 does not exist only the child of #3 . Question; Is the child #3 entitled to what would be her mothers had she been living ? Is there any case law on this and if so where can I find it?

Thanks

W.L.

Re: Who's entitled to what?

Assuming Virginia law applies (i.e. grandaddy lived and died in Virginia), the child of child #3 would receive her mother's share. The intestate succession laws are found in Section 64.1-1 of the Code of Virginia.
