Legal Question in Wills and Trusts in Virginia
The home and property that my husband and I live in is in his name only. I would like to know if my husband died before me would the home and property come to me since we are married?

No, not necessarily, if he was married previously and still had children
surviving at the time of his decease from that marriage.

Of course if he simply creates a will, this will eliminate all question. But normally if you are his wife and he was not previously married, then you would inherit the house.
