Legal Question in Wills and Trusts in Virginia
wills
how do you properly change a will that has property divided equally between three children but one child has received monetary amounts that equal as much as 1/3 of the estate would be? there would still be tangible items that would go to the child that has received the monetary amount now and that would be denoted but we need to insure that she realizes that her money already received is to come off of the top of her 1/3 share.

Re: wills
It's just a matter of letting your attorney know the facts and asking that the will be redrafted.
If you are trying to draft the will yourself, be careful and ask someone, for examply, your executor, to review what you have written and tell you what it says.

Re: wills
As previously stated, simply have the current will amended to reflect these new facts with respect to this beneficiary.
