Legal Question in Bankruptcy in Washington
Pay Day Loans
I currently have a few payday loans I have been paying them on time. My problem is that I have bad credit due to medical bills and because of these pay day loans I am getting behind on my current bills. If you claim bankruptcy can you claim these pay day loans along with your other creditors?

The presumption would be yes, but if creditor (lender) could show that loan was taken while BK was in the picture, then could potentially fight discharge. Also, if less than 90 days passed between loan and BK filing, then presumption could be toward no discharge.
