Re: business name and domain name
Generally speaking, when it comes to the use of trade names, the rule is "first in time first in right," meaning in short: whoever starts using the name first, regardless of when that use was "registered," is allowed to continue his/her use. The domain name is different from a trade name, so my opinion is that you do not have the "right" to the name, and cannot force the current user to abandon the domain. Please feel free to call me if you have any other questions.
