Legal Question in Civil Rights Law in Washington

I am a mother that I was beaten and mugged in the middle of a customer filled..tape rolling... gas station. While my kids were in the car...I I told the teller to call 911 as soon as I realized what was happening. No one called.....no one helped me. It wasn't until after it was all over that they called after I had demanded them to. Can I sue the store for not calling 911?

I have to admit that I have not researched this topic, so this answer is more highly educated guess than well researched answer. That said, I believe you have a cause of action for negligence in that the store attendant or owner had a duty to ensure your safety if reasonably possible and failed to do so while you were being mugged in front of them, as well as by refusing to call the police.

I suspect they did not want the negative attention police lights and sirens might bring. The real question will be what damage did you suffer and how to prove it? That's a difficult one, given that you will have to prove how it made you feel, as opposed to having a broken leg in a car accident, where proof of damages is readily apparent.

By the way, there are other potential causes of action that you may have, such as negligent infliction of emotional distress; intentional infliction of emotional distress, and maybe some others that don't readily come to mind.
