Bushing Law

I purchased a used Pickup truck on Nov 30th 2007 from a Dealership. I traded in my vehicle. It was to be financed through US BANK for X amount of $$ for X period time.. The dealership paid off my trade on Dec 7th.

Now on January 8th 2008 I got a phone call from the finance dept telling me that US BANK didnt approve the loan because they dont do that long of a contract. (84 mo). They then wanted me to come in to re-sign papers for another lender.That set off the red flags with me. I asked the finance people in the dealership I work at and they said they have violated the BUSHING LAW and that the financing should have been finalized within 4 days.

I have returned the truck to them but they are saying I have to pay them because they will asume the contract... Bushing law states any financing must be final within 4 days, or the contract must be voided.

I have reported this to the Atty Gen Office and Dept of Licensing.

WHoever told you to contact the AG and the DOL gave you good advice. You also did the right thing to return the truck. Now, you should be able to get out of the contract. If the dealership refuses, you can always hire private counsel to straighten this out for you.

Even if it costs you money, a lawsuit that you file against the dealership will provide that your attorney fees will be paid by the party that loses.

I don't mean to imply this is a sure thing, but the violation sounds egregious.
