Legal Question in Consumer Law in Washington
car loan pay off question
After a pay off quote was made, we
sent over 21,000 to pay off a car loan. At around 2 months I called to check on the title, the company informed me that the loan was not paid off and that we owed 233.00.
That day I talked to alot of people and it sometimes I got the feeling that no one knew what was going on. Later I talked to a manager that said that they made an error and applied the money as a payment not a payoff.
I did not agree with the 233.00 owed. They set a date of 10/08/07 that it was due. At first I was going to pay by then. But the manager that I talked to said that I probably could get by pay it off at the end off the 5year term. (plus interest) so I wasn't in a big hurry to pay it off.
November collections started harrassing us with mutiple phone calls daily. I payed it off when I got threats of reprocess the car.
Now it's hit the credit report that it's paid off along with a negitive remark.
Is there anything I can do to get my credit report changed?

Re: car loan pay off question
You can write to the credit reporting agencies and request that they place an addendum in your report that shows your side of the story.
You can write to the lender and spell out your side of the story and request that they correct the report they made to the credit reporting agency.
Sounds like this was a bad experience for you. All I can really suggest is that when you revise a contract, be sure to get the terms of the accord and satisfaction in writing so that there are no questions about who said what when. If you had been conducting this negotiation in writing, you could prove what happened and where the disconnect was.
I hope this helps. Elizabeth Powell
