Legal Question in Criminal Law in Washington
I had a 4th degree assult charge against me dismissed in 2013, but was charged in 2011, how can I get this off my record? I was in a bad place at the time and I'm not that kind of person. What do I do?

It depends on a number of factors. You can have non-conviction data expunged after the later of two years after the charge was dismissed or three years after the date of arrest. But it depends upon the conditions under which the charge was eventually dismissed. Was it after a deferral period of some type? Did you have to comply with any court imposed conditions? You should go to the Washington State Patrol website and look up expungement of non-conviction data. There is a chart there that guides you through the analysis of your situation. You can fill out the form yourself or have an attorney help you. Good Luck!
