Legal Question in Family Law in Washington

Changing child support obligor

My ex wife is in the military and is being deployed over sea for 6mo or more. As per my divorce papers it states that if she is gone longer then 30 days I receive custody of the kids till her return. How can I go about getting a change in the child support payments made to her while I have the kids. Originally when she was in boot camp and school she paid me child support while the kids where living with me, and changed when they went back to her, but this was never documented to happen again if the case arised again. Is there someway it can be changes that she would be obligated to pay me support while the kids are with me? What steps would I take in doing so? Also the divorce was settled in Arizona, I now live in Florida and my ex lives in Washington state, which is also where payments are enforced. Thanks for the help. Matt

Re: Changing child support obligor

Matt,

You basically need to file for modification of custody and support. This can be done to adjust support back to you while your wife is away. I would suggest that the next order the court approves encompass what happens in the event your wife has to leave the kids with you. That will prevent each of you from having to run to court ton continually modify the support order. It will also save you both a lot of money in the long run.
