Legal Question in Family Law in Washington

child custody

I had custody of my daughter pending a court hearing to see if the court would honor a foreign court order. The presiding judge ordered me to grant visitation and upon doing so the mother fled to another state with my daughter. she is a gambler and continues to do so. what can I do?

Re: child custody

You should get in touch with an attorney immediately, who is local to you, and can get into court ASAP to file a motion for habeus corpus for your daughter and have it enforced where ever the mother and your daughter may be found. That will allow them to remove your child from the mother's custody.

You then need to make a motion for a temporary Parenting Plan until your matter is finalized, whether that finalization happens in Washington or the original jurisdiction- depending on which is the appropriate forum to hear the case.

If you sit on this and do nothing, you are endangering your chances of getting your child back. Time is your enemy in this matter, so get going ASAP. Best of luck to you!
