Legal Question in Family Law in Washington

Children in danger

I found out that my kids father is now using heroin. He called a neighbor over the weekend and told him that if he didn't bring $300 over, drug dealers, who were at his house, were going to hurt him. My question is this: How can I legally keep my 3 girls from going to their fathers house for their weekend visit? I am afraid that if they do go down there the worst will happen.

Re: Children in danger

If I were you, I would immediately seek counsel, and then go to court to obtain an emergency protection order that halts the visitation pending a return hearing in two weeks, where your ex will be able to explain his side of the story.

You are going to need a declaration from the neighbor attesting to the request for $300 otherwise harm would come to your ex, and from there, depending on your ex's explanations, visits will resume or some modification will need to happen.

Additionally, you will need to file a petition to modify the parenting plan to deal with this new information. If the situation is as dire as you say, then if you can afford it, by all means, don't try to do this one yourself. I provide a 30 minute free consultation by telephone, so if you want, give me a call later today and I'd be happy to at least expound on what I've written above.
