Custody of 16 yr old son
My son is 16yrs old. He's failing every class, has no respect for authority at school and has threatened to commit suicide. His Mom does nothing. I want to know if these are reasons enough to fight for custody or if a Judge would just listen to my son's wishes due to his age. He doesn't want to live with me because he won't be near his friends, which could be some of the problem. Currently his Mom lives about 50 miles away from me. He has gotten much worse over the last 2 years and I fear all will be lost if I'm not able to step in and help him. Thanks

If your son is suicidal or has expressed that he has considered suicide, even if done in a joking manner, I think that coupled with Mom's lack of action are enough to at least ask for an evaluation, based upon which you can ask to modify the current parenting plan. I'm not saying you will get custody of him for sure, but if helping him is your main concern, at least you will accomplish that. Before filing anything or hiring a lawyer, I suggest you and Mom talk (or you should at least try to talk to her) about getting him some psychological help.
There is no stigma to this. Look at it as a tune-up for the brain. Everyone needs it, and quite frankly, you ought to go with your son and ex-wife. The whole family could probably benefit. It certainly won't hurt you.
If Mom refuses to even consider such a suggestion, then my advice is to hire an attorney and file for modification of the parenting plan. Good luck!
