Legal Question in Family Law in Washington

Can two fathers both having children and been married to the mother open a child custody case together, if the mom is planning to leave the state? Basically husband #1 had a child with mother husband # 2 had child with mother. Now both are divorce and mother plans to leave the state. Can both fathers open a case together?

The short answer is no. Different kids, different fathers, and the mother is the only thing in common. That's not enough to join the cases. Each father will have to file separately, although they can each keep the court�and in fact are required to�apprised of what is happening in the other father's case.
