Legal Question in Family Law in Washington
Financial Distress During Pre-Divorce Period
Husband is on work disability and is collecting money from the state, and has decided to ask for a divorce from wife. They have two children, and are barely making mortgage payments and paying their bills. Husband continues to live in home, but refuses to pay any money towards living expenses, child support, etc. He's currently trying to sell their property (secretively) on eBay auctions. Without his income contribution, wife cannot make mortgage payment. Husband and Wife filed for bankruptcy last year, and husband doesn't care if wife loses the house, or about his own bad credit rating.
This all happened just last week. I'm the brother-in-law trying to pursuade Wife to consult with an attorney. Any advice and/or comments would be appreciated.

Re: Financial Distress During Pre-Divorce Period
Brother-in-law,
You are on the right track, in terms of getting sister-in-law to at least consult an attorney. That will help her see things from a neutral point of view.
Beyond that, for now, I am going to hold off on other comments, because the consultation is what she really needs, as this sounds like a complicated situation. If you like, you can call my office for a free telephone consultation that can at least get your sister-in-law started and allow her to make an informed decision about how to proceed and what costs to expect, as well as what to expect by way of child support and spousal maintenance (commonly called alimony).
