It depends. What do you mean when you write that you cannot find him? Does he just ignore your calls and e-mails? Or, is the phone disconnected and after you visited the father's home, found it deserted?

If it is the latter, I would call the police and report your son as missing. If you are being ignored on the other hand, then I would write the father a letter, sent by certified return receipt, noting your attempts to contact him to retrieve your son and his refusal to do so, or ignoring you, and tell him he has 5 days to contact you or you will file a motion for contempt to get your son back, and seek attorney's fees (because you are going to hire an attorney to handle this for you).

Depending on where the father livesin state or out of stateyou may have to involve other law enforcement to retrieve your son and possibly obtain a writ of habeus corpus to get out of state police to physically take possession of your son for you.

Bottom line: I (or anyone else reading your post) will need more information to more accurately answer, but even so, you ought to consult an attorney ASAP about your options.
