Legal Question in Family Law in Washington

Husband never divorced previous wife

My husband and I were married in Washington state. Later I found out he

never got legally divorced from his previous wife in Oregon state. He and I are

now separating. Was our marraige ever legal or can I have it annulled and not

be responsible for his personal debt?

Re: Husband never divorced previous wife

Since your husband's former marriage was never legally terminated, your marriage to him can be annulled, although that is not the legal term in Washington. Here we ask for a declaration of invalidity of the marriage because the marriage is "void ab initio" meaning void from the start.

As to the issue of his debts a lot will depend on when and how those debts were incurred. For example, is there a car or house that he purchased and placed your name on the title? If there is a way that you can be tied to his personal property acquired during your "marriage" then you may still be held liable for those debts.

Ultimately, I suggest you call me for a free consultation and to assess your needs, if any.
