Legal Question in Family Law in Washington

My ex husband and I were divorced in 05" at that time the divorce decree stated that all jewelry was to be retained by me. My ex said he could not find my wedding ring and it must be lost. I saw him and his new fiance over the weekend and she iswearing my ring. Am I entitled to it back? THe diamind has a serial number on it so it is tracable.

I would have to see the language of the decree itself, but from you write, yes, I think you have a case. Here is the tricky part though. Suppose you bring the proper motion to get possession of the ring. I can't help but imagine that the moment your ex gets those papers, suddenly, the new wife's ring will either disappear or she'll be wearing a Wal-Mart special that is different than the one you know if yours and they'll just say that you don't know what you're talking about.

Now, even if he plays games like that, there are ways to get around him and prove that he switched rings, such as a comparison of photos of you wearing the same ring as he and his new wife in say a wedding photo, but you'll spend thousands of dollars chasing down the ring.

If you succeed, you may be able to recover some or all your attorney's costs, but don't bet on it, since the chances of success are by no means guaranteed. Knowing this, you have to ask yourself what is the ring worth to you?

If we look from a purely monetary point of view, I'd say if the ring's current fair market value (what you'd get for it if you sold it on eBay or traded it in) is less than $10,000 then you should probably forget about it. If it is more than that, then I would say it is worth at least meeting with an attorney to look things over to see if from an evidenciary point of view you can succeed in a case to get the ring back.
