Legal Question in Family Law in Washington
My ex husband fraudulently filed EIC on our oldest daughter. He is allowed to file Child Tax credit on her if he is current on his child support. He has not paid child support in over 2 years. What can I do?

Get an order of contempt for failure to pay child support. File your tax return with the IRS claiming the child tax credit, and provide the IRS a certified copy of the child support order and the order of contempt, in explaining why you are claiming your daughter, and the IRS should be able to sort it out and properly award you the credit and send your ex a tax bill.
