Legal Question in Family Law in Washington

My Husband through me out of his house (jobless) in July of last year, he has not paid me maintenance or child support.I am still married (not divorced or legally separated but living separately). I have been a stay at home mother since the birth of my daughter a year and a half ago. Am I still entitled to half of the tax return?

Yes and no. It can get confusing without a court order to step in and clear things up. I suggest you immediately hire an attorney, even if you have to borrow funds to pay the attorney. Get your divorce started, so that you can get a temporary order giving you at least half the tax return, to avoid any complications, and to get an order of child support put in place temporarily and even spousal maintenance if the court finds there is a need on your part and an ability to pay on your husband's part.

The worst thing you can do is nothing. Your husband will file and claim 100% of the return, spend it, and you will never see any of it.
