Legal Question in Family Law in Washington
Husband's daughter will be 18 next month and is a senior in high school. We just found out that she is not residing with her mother. Not since Dec. 2010. The mother has moved out of the school district. Child is remaining ins school until graduation in June. Child support is still going to the mother. In my opinion, the mother is not entitled to this support as the child no longer resides with her. I think it should go to whom ever she is living with. Is this going to be an easy fix or is it going to be a difficult fix?

You pose a smart question�easy or difficult fix? Depending on how much child support was paid monthly, maybe it is worth going back to claw some of the money back. That said, considering that your husband's daughter will be 18 next month, so that there is just one payment left to go, unless she is still in high school, in which there are normally payments due until she graduates high school, maybe it is not worth pursuing.
The following may help put it into perspective: Hiring an attorney will cost anywhere from $150-$300 per hour, depending on location, years of experience, etc. That attorney will probably have to put in anywhere from 15-20 hours to sort it all out, so figure from $2,250-$6,000 to sort it all out. Don't forget to add in a day or two of your time to attend court and maybe meet with the attorney, plus time looking over legal papers to sign and get back to your attorney and time spent talking to your attorney.
