my sons girlfriend is going to have a baby she is 16 and wants to move in with us she is here 95 0/0 of the time,If she moves in we want to become her guardian

Without her parents' consent, or a determination that both of her parents are unfit, you are going to have to go to court to get a judge to declare her parents unfit, and to determine that you are the best guardians for her.

That will be an expensive process. I would need want to know your reasons for wanting to be her guardian, because I gather that there is more to it than you just want to do this while she lives in your home.
