Legal Question in Family Law in Washington

Hello I live in Washington state, My husband has a house in his name and the loan is in his name. He just bought the house one year ago. While we were married. If I divorce what happens to me as far as resposibility for the loan, if he renigs on the loan?

Unless he refinances, the loan is presumed to be community debt, since it was taken out during the marriage. Regardless of whether your name is on it, unless a quit claim was filed at the same time, and the loan indicates that this is his separate property debt (as opposed to community debt).

If it is community debt and he does not pay the loan, the bank may come after you and your husband, which will affect your credit as well.
