Can I move out of state with my daughter and start divorce and custody papers?

Yes, technically speaking, but that would depend on what laws that other state you move to has about residency requirements for filing for divorce. That said, your husband may try to get the case moved back to Washington, and he may very well succeed if it has been less than six months that you are out of state when you file.
