Legal Question in Family Law in Washington
obtaining a passport for child
My x and I have joint custody of our 5 year old. I want to get a passport for my son as we want to take him on vacation with us (boyfriend and I) my x is refusing to allow me to get a passport stating that I am a flight risk because my boyfriend is an airline pilot. I have a full time job here my entire family lives here and my boyfriend is in the military reserve based out of the us. Do I have a leg to stand on if we take him to court? I am not a flight risk and would like to take my son on vacation with me.

You definitely have a leg to stand on in court. Unless your parenting plan has specific restrictions or requirements that both parents agree before either parent is allowed to travel outside the country with the child, then you will likely prevail on a motion to secure your ex's cooperation in obtaining a passport for your child. By the way, you should also seek orders to have your ex sign a notarized letter that he grants you permission to take the child outside the USA for the dates indicated on your travel itinerary and to the places indicated on your travel itinerary. The letter should include the father's contact information and home address, just in case.
Many countries' immigration and customs authorities are on the lookout for kidnapped children, and parents are the most common of such offenders. So, to make sure that you have as few problems as possible, get that letter too.

There are several sites where you can find the format for the consent to travel outside of the United States with child.
