On parenting plan that is not legal

my brother has a non legal written parenting plan with his wife they have not filed for custody/divorce she has her new boyfriend spend the night and is sleeping in a bed with him and my 4 year old niece my brother fears for his daughters emotional welfare if he does not follow their agreed plan will it be held against him by a judge when they do go to court

The short answer to your question is probably no, it will not be held against your brother if he does not follow their "non legal parenting plan." On the other hand, things could go the other way, especially with the passage of time.

Your brother needs to do himself and your niece a favor right away, and that is to get divorce papers filed and have a motion for a temporary parenting plan filed as well, so that he can have something that is legally enforceable in place.

I would say that no judge or commissioner will allow for mom to keep a 4 year old in bed with boyfriend (totally inappropriate) but your brother can't do anything about it until he files and gets the legal process started.
