Post Secondary Education

For 14 years I had been solely contributing to a college fund for my son. The balance should have been $25,000. I discovered that my spouse has squandered it. Can I be credited that amount toward my post secondary education obligation and only be respobsible for the remainder that I would have had to pay towards college if the fund was in tact? If not, I will be paying for his education twice!

Your case poses a lot of questions that I would have to ask before being able to give you any definitive answers. For example, why did your wife take the money out? Was the money in an education trust account set up for the benefit of your child?

A short answer is that IF she fraudulently took the money, than MAYBE your contribution toward post secondary education will be reduced, assuming you are even ordered to pay for such contributions.

Your finances will also play a huge rule in making such determinations. For example, if your wife is a millionaire and you make $24k per year, it is highly unlike you are going to be ordered to pay for post secondary education for your son.
