Prenuptial agreements

Do you have to have a legal form to have an agreement and does it have to be filed in court? Is there a waiting period from the time you sign the agreement before you can get married?

You do not need to file anything with a court, however you do need to have a written agreement. I suggest that you and your future spouse each have your own attorney during this process.

Additionally, if you plan on living in Washington, I would recommend executing a postnuptial agreement, as I find these are more easily enforced at divorce than a prenuptial (for a variety of reasons too long to get into here).
