Relocation of Child

My girlfriend and I of 6 months are planning on getting married. She lives an hour and a half away from me and wants to move into my residence. She has a daughter in which the father has everyother weekend and on wensday evenings. I also have two sones which I have everyother week. Her ex-husband is saying he will fight the move. So my question is, If we are married, will the court allow her to move up here or are we going to have to be apart? Thank you very much!

WA parenting plans are subject to the Relocation statute that requires parent wanting to move outside the child's school district to provide notice to the other parent.

She has to give notice; he has the opportunity to object. She should figure out a way to provide make up visitation in a new plan that accounts for the distance - Wednesday nights are going to be tough with that drive.

However, presuming that you have a good job and ties to your community it is clearly logical that she would want to relocate. Courts are loathe to get in the way.

Moving just to spite the other parent, on the other hand, is problematic. So you want to present her case in a light favorable to her, and recognize that there is an additional burden on him to see his child.

There are other ways to do this. What about both of you picking a new place halfway in between?
