Legal Question in Immigration Law in Washington

My friend is an ilegal alien but is married to a US Citizen and wants a divorce

I have a friend that has lived in the US for more than 12 years and has been married for a little over 10 to a US citizen. They have a child together but my friend has guardianship over him. He now is looking into getting a divorce but wants to know what his rights are. Is he able to stay in the USA legally? How should he go about getting his papers?

Based on the information you have provided, I have a lot of questions that would need to be answered in order to give you an idea of what can be done for your friend.

First, what is your friend's immigration status at present? Do they have a green card, have they been here illegally for the past 12 years or at any time during the last 12 years?

Second, where was the child born? I assume the United States, but you have not indicated so. That may become important depending on your friend's immigration status.

If your friend was never sponsored by US Citizen spouse..at this point...he/she is only eligible for cancellation of removal provided no criminal records or previous deportation order.
