Legal Question in Immigration Law in Washington

Hi, I was stopped by border patrols. They released me under a bond because my criminal record was clean and I had not done anything illegal in the US. I came with a I-94W(visa waiver). Well, they set up for me to go with immigration and once I reported with them like I was suppose to, they told me that i would be deported because with the visa I came under I had no right to see a judge is some section 217. Now I have an order to be deported next month. They told me that if i start paper work since I am married to an american citizen. Now I am wondering would immigration deny my application since am i have an order to be removed from the country? I am 100% supported by my husband, we did taxes together, and we share bank accounts and the apartment lease together. We have a very good relationship with each other do they take that in count?
