Legal Question in Employment Law in Washington

Stop payment on paycheck

My son worked in washington state for his biological father for 6 months. His August paycheck was given to him after my son gave his notice that he was moving back to Oregon. My son took his paycheck to the bank and had it cashed. My son was informed by his bank via mail just today, that his biological father(also his boss) put a stop payment on that paycheck and the bank then took the amount back out of my son's account. What can my son do to get his money for the months work that he did? My son has the original check with the stop payment stamped on it.

Re: Stop payment on paycheck

Washington law provides for a 100% penalty, plus interest and attorney's fees to be paid by an employer who does not timely pay an employee's salary or wage. I can't see that the father-son relationship would alter that obligation of the employer, although there does seem to be something that is not in your query that might explain why the father-employer changed his mind and stopped payment on the pay check.
