It depends. You contend that the truck driver assualted you. Was the truck driver working at the time? If so, a claim might be made against the employer for negligent hire, etc. If he was not working, its likley that no insurance exists to pay any judgment. You might also try the Crime Victim's Compensation Fund to assist you in paying for the bills.

There is no accurate answer to your specific question about what you can expect from a settlement out of court, versus from a trial. The best answer (and most unfulfilling answer) is that "it depends."

It depends on how much damage the motorcycle rider suffered. What are the costs of medical care? Are the injuries permanent? Did the motorcycle rider have a job? If so, how much does he make and how long will he be out of work? How old is the motorcycle driver?
