Legal Question in Personal Injury in Washington
Sales Promo
A local scuba dive shop offered a free trip to Fiji if you purchased $2,500 goods. I did. I did not win the trip. When I emailed them they said, ''A young girl named Tina won.'' I asked, ''What's her last name, number, can I call her and congratulate her?'' He mailed back, ''You think we're not legit???''
Do I have a case?

Re: Sales Promo
To properly answer your question, I'd have to know how the scuba shop's offer was presented. Was it in writing? Was it in the form of an ad? If it was not in writing, you are basically out of luck since proving the statement is next to impossible unless the person who made the statement admits to it.
If it's in writing, I need to see exactly what was written. Was it a lottery? I ask because you mentioned winning a trip. If it was a draw or lottery where you gain entrance based upon a $2,500 purchase, that is not a guarantee to provide a trip.
If you are really serious about this, it's going to be tough. By the time you get done paying an attorney to represent you, assuming you have a case, even if you win, you'll break even at best.
