Re: Accident - Charged with reckless driving

"Reckless" driving in MOST states is a criminal misdemeanor charge, not merely a traffic infraction. As such, JAIL is possible, which is not, ordinarily, possible with a traffic infraction.

You should be able to find the Washington statutes online easily, either with a google search, or at the website of the Washington State Bar. My own website (www.yourinjurylawyers.com) has links to such sites. HOWEVER, to be safe, you really should TALK TO A LAWYER IN PERSON, and do NOT rely on what you find online. There are many nuances of meaning and language in a criminal setting (plus normal-looking words that have special legal meanings, and it's not worth taking a chance without at least CONSULTING with a lawyer, if not actually hiring one to represent you.

There may also be serious civil consequences against you which could arise as a result of the outcome of the Reckless Driving charge. So, FIND a lawyer and talk to one, is my advice! Good luck,

Re: Accident - Charged with reckless driving

Reckless Driving (RCW 46.61.500) is defined as operating a motor vehicle with willful or wanton disregard for the safety of persons or property. It is a gross misdemeanor with a maximum penalty of 1 year in jail, $5000 fine. A conviction also results in a 30 day suspension of your driving privilege. Reinstatment requires a fee and the filing of an SR22 certificate (high risk liability insurance) for a period of 3 years.

Reckless Driving is considered a serious traffic offense. If a person incurs three serious traffic vioations within a 5 year period, the privilege to drive is revoked for 7 years.

You should enter a plea of not guilty and be represented by an attorney. Reckless Driving is a serious criminal charge.
