Legal Question in Bankruptcy in West Virginia

What creditor needs to do after debtor files bankruptcy?

I am a creditor of someone that filed chapter 7. I was sent a schedule F form. Is there anything that I need to do, as the creditor, to help me get my money back?

Most debt is discharged in bankruptcy. Debt that may not be discharged is alimony, child support, taxes, student loans and others. There are exceptions to the list and within the list. However, normally unsecured debt, not obtained by fraud, is discharged. Consensual liens ordinarily remain. You should consult a bankruptcy lawyer and provide him or her with the detail of your situation. You may have a remendy. It should be worth them minimal consulting fee for the review. Time limits for filing an Adversary Proceeding to object to discharge of a particular debt are strictly enforced. You cannot wait to find out what your rights are.
