Spring under drain field

My wife and I bought a newly constructed house this past March. A few days later a spring came up below the drainfield and septic water was discharging on top of the grass. The seller said it was not his fault. He paid $1500 of the total $4000 required to fix it. Three months later, it was fixed. Is there any legal action I can take over this? If so, how would I go about doing it?

In general, it depends. If there was a warranty on the property, then you may have a case. I am not licensed in WV, thus you need to speak to an attorney in your jurisdiction to ascertain your rights in this case.
