Legal Question in Wills and Trusts in West Virginia

Laws of Probate

My Mother died, my sisters name was on safety deposit box. She claims that our mother asked her to go to deposit box and retreive will and bring back to hospital. She also claims that our mother asked her to tear up the will. She claims she did this. She also claims that she was verbally told that her and our brother John were to inherit all.

For the past 30 years the will stated that her jewelery was to go to my sister and the house to go to my younger brother Mike.

What are my options at this point? Thank you for information you can provide to me in this matter.

Re: Laws of Probate

If there is no will and no surviving spouse, then all children will inherit equally. If any child is deceased, that share goes to the deceased child's children.
