Legal Question in Construction Law in Wisconsin

Can I put a lien on his property

I moved in with my boyfriend in May of 2002. He told me at that time he would put his house in both our names. I told him I did not want the house in my name that I believed it should go to his children. Then he asked me to pay for labor on an addition he wanted. I agreed as long as he protected me in some way so the children did not kick me out if he died before I did. He agreed to this and told me to write up an agreement and he would have it notarized. I wrote up an agrement for $10,000.00 dollars and gave it to him. He took it and said he would have it done at work. In the mean time we had the addition put on and I paid close to $10,00.00 for labor. Every time I asked him about our agreement he would put me off. Using the excuse he did not want them to know about it at work. I kept suggesting to go to an independent place to have it notarized. He just kept putting me off. It is now November of 2003 and we have broken up over this. I asked him for my money back and he said he had no plans of paying me back or protecting me in any way. I moved out the 1st of October. I have my canceled checks and the person who did the labor is willing to stand up for me. Is there any way I can get my money back or place a lien on his property?

Re: Can I put a lien on his property

Hello,

This is a very difficult situation. There is some law in your favor and some against. And a lawyer would likely charge you an hourly rate to pursue it. If you have the money to hire a lawyer, it would be worth your while to get an opinion to see if you can recover some back. In fact, talk to two lawyers, and get their opinion and go with the one you feel more comfortable with. I have to be general because these are close cases that can go either way depending on the facts and what you want to do and can afford.

Best wishes, Mark J. Mahoney
