Water erosion at new home

I moved into a newly built home 5 months ago (1 year warranty). Spring thaw/rain is washing out my concrete driveway/sidewalk. My general contractor (responsible for the rough grading)is blaming the neighborhood land engineer. I did express concerns 3-4 times to my contractor during the building process (In hindsite it was obvious during small rains earlier on). The neighborhood design engineer does determine elevations, runoff...but likely was never made aware of my earlier concerns. I expect repairs may run upward of $10,000. Who gets stuck with the bill and what should I do now to ensure I don't get screwed? Thankyou.

The general contractor was responsible for making sure the project was going to turn out, or he should have pointed out the problem early on. These cases turn into a real mess, but I know that is no comfort to you. Hire a lawyer to write a letter to both parties, and maybe between them a settlement can be achieved. Best wishes, Mark J.
