car repossession

I have just been summonned to appear in court because of delinquent payments on my car loan. if i pay the past amount, do i have to appear in court? will my car be repossessed? i never received any letter before stating any of this. all of a sudden i was summoned. i hav ethe money for the 2 months i was behind.

Car Repossession, Repossession (Replivin) Suit, Chapter 13 Bankruptcy Can Stop These

If you want to save your car, you need to fight the Replevin suit, and need to retain a bankruptcy lawyer as soon as possible. If you do not contest this suit, the lender will have the right to take the car at any time, regardless of whether or not you catch up the payments. However, odds are good that our lawyer might be able to worked something out if you do catch up and stay caught up. Even if they take the car, a chapter 13 can sometimes get the car back provided that it is filed before the lender resells the car at auction. Keep in mind that hiring a lawyer to file a bankruptcy is not the same as filing it. The lawyer will generally need weeks (to months) to prepare the necessary filing paperwork. You there cannot wait until the last minute and expect the lawyer to save your car.
