Wage Garnishment Poverty Exemptions

Yes, any asset can be seized by a judgment creditor in an attempt to satisfy an unpaid judgment, including wages, even if you are poor. However, there are protections available in poverty situations if you assert them properly in court. You should consult with a bankruptcy attorney as soon as possible in order to explore your exemptions from garnishment and other options in this regard. The attorney may also advise you of options for claiming poverty exemptions other than bankruptcy (if you are too poor to even go bankrupt). Bankruptcy, however, is the most convenient way to claim all of your exemptions at once and have all or most of your debts discharged in a single proceeding.
