Legal Question in Family Law in Wisconsin

Trying to Find Out If My Mother's Marriage Was Legal

My mother recently passed away and since then it has come to my knowledge that my stepfather, who was married before, never got a divorce from his first wife, instead he legally changed his name then married my mom, my question is, is there any way that this marriage to my mom was valid or legal and if not, is there any legal procedures that need to happen to him now that my mom has passed away, she was not aware that he wasn't divorced when she married him, he was married to his first wife in Wisconsin and married my mom in Texas.

Re: Trying to Find Out If My Mother's Marriage Was Legal

Hello,

It is likely that the marriage was void. However, because your step-father died first,

I doubt if there is anything special that needs to be done at this point. That is difficult to say, though, given my lack of facts with your case. You should double check this with whoever helps you take care of your mother's estate.

Best wishes, Mark J. Mahoney
